Anti-Spam Legislation. Some jurisdictions, such as Canada, have legislation regulating certain activities that discourage reliance on electronic means of carrying out commercial activities (“Anti-Spam Legislation”). These jurisdictions may prohibit sending to an electronic address a commercial electronic message [defined in Canada, for instance, as “an electronic message that, having regard to the content of the message, the hyperlinks in the message to content on a website or other database, or the contact information contained in the message, it would be reasonable to conclude has as its purpose, or one of its purposes, to encourage participation in a commercial activity …”, or “CEM”], unless: (i) the person to whom the message is sent has consented to receiving it, whether the consent is expressed or implied; (ii) the message is in a form that identifies the person who sent the message and the person – if different – on whose behalf it is sent; (iii) provides information enabling the person to whom the message is sent to readily contact such person(s); and (iv) sets out an unsubscribe mechanism.

Iceberg Networks Corporation (“Iceberg”) has developed the “Iceberg Risk Intelligence Academy” (the “ACADEMY”), which allows registered users such as You (i.e. those individuals who have supplied their first and last name, company name, company address, title, email address, and phone number) to access, view, download, and/or use one copy of certain content and documents (the “Academy Documents”) that are made available at www.icebergnetworks.com (the “Website”) for their own personal use. By clicking on the box next to “I permit Iceberg to contact me with future updates and information, in accordance with the following terms and conditions”, You are providing Your express consent for Iceberg to send you future electronic messages on occasion that Iceberg believes may be of interest to you, until such time as You unsubscribe to same. In all such circumstances, Iceberg will be identified in the CEM, appropriate contact information of Iceberg will be provided, and an unsubscribe mechanism will be set out wherever possible.

In this respect, if you wish to revoke any implied or express consent previously granted, you may do so via the website. Similarly, there is an “unsubscribe” link in each CEM, as noted above, that you may utilize to unsubscribe from any future CEMs that may otherwise be sent by Iceberg.
